RELEASE OF LIABILITY AND ASSUMPTION OF RISK

Recess is an amusing class activity that provides movement, relaxation and an opportunity to be self expressive through Play. It also comes with risk and by acknowledging the following, you assume full responsibility for your current health status and participation.

1. I confirm that I am in good health and physical condition and do not have any medical or other conditions that would impair my ability to participate in Recess and will also follow all instructions, recommendations, and cautions of the Lead Instructor at all times during Recess. If at any time I believe that I am no longer in proper physical condition to participate in Recess, I will immediately discontinue any and all activity.

2. I understand that my participation in physical exercise, including the use of equipment involves the risk of injury, disability, property damage and even death. I further understand that the Lead Instructors and others participants cannot guarantee that I will not experience injury. Notwithstanding these risks, I acknowledge that I am voluntarily participating in a Recess class and agree to assume all of the above-mentioned risks as well as psychological injury and financial loss arising therefrom, whether caused by the negligence of the Lead Instructor or any/all participants.

3. I waive and release all claims, now known or hereafter known, against the Lead Instructor and other participants on account of personal or psychological injury, pain, suffering, disability, death, property damage, or financial loss attributable to this activity, whether arising out of the negligence of the Lead Instructor or otherwise.

4. I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during or as a result of Recess. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and evacuation. I release, forever discharge, and hold harmless the Lead Instructor from any claim based on such treatment or other medical services.

5. This release may not be orally modified and constitutes the entire agreement of the Lead Instructor and myself with respect to the subject matter contained herein and supersedes all prior and contemporaneous agreements, both written and oral, with respect to such subject matter. If any term or provision of this release is deemed invalid, illegal, or unenforceable, all other terms or provisions shall remain in full force and effect.

PICTURE WAIVER

1. I understand that pictures/videos will be taken in class periodically to be used for marketing purposes on social media including the Return 2 Recess website. I further understand that I can opt out of the pictures/videos at any time by alerting the Lead Instructor or any volunteer present in class.
